The Bombay High Court (Aurangabad Bench) has ruled that a woman who left her matrimonial house before getting a divorce, cannot later seek the "right to residence" under the Protection of Women from Domestic Violence Act of 2005 (DV Act) even if the woman's appeal against the divorce decree is pending.

The Bench of Justice Sandipkumar More quashed the lower court's order granting the right to residence to a woman including access to amenities in the house.

The court also noted that Section 17 of the DV Act provides a right to residence but it is only available if the woman continues to reside in a shared household before the divorce.

The bench made these observations while hearing a revision plea filed by the in-laws of the woman challenging the Magistrate's order allowing a divorced wife to reside in a shared household (the matrimonial house).
The in-laws also claimed that the house was in the name of her father in law (the husband's father).

It was also pointed out by the in-laws that the family court had dissolved their son's marriage in July 2018 and also submitted that the wife's appeal against the order is pending before the High Court.

The court noted that the wife left the matrimonial house much before the divorce and the wife has not put any material on record to show that she is forced to leave the matrimonial house by her husband or her in-laws.

In this context, the court ruled that the wife is not entitled to claim residence in her matrimonial house.

Case Title: Umakant Havgirao Bondre versus Sonali Suraj Bondre

Bombay high court relief for NRI accused of rape, cheating

8-05-2015

MUMBAI: The Bombay high court has come to the aid of a UAE-based NRI who was accused of raping and cheating by a Pune resident, who he had met on a matrimonial site and their proposed marriage was cancelled.
A division bench of Justice Ranjit More and Justice Anuja Prabhudessai quashed the first information report (FIR) registered against Nitin Jadhav (47), a divorcee with a 13-year-old son. The woman, Seema Patil (48), also a divorcee, claimed that Jadhav had forced her to have physical relations and then gone back on his promise to marry her.

"The facts unequivocally do show that Jadhav was serious about getting married to Patil, however, the mutual plan could not go through due to strict conditions imposed by her, to which the he was not agreeable. By no stretch of imagination, from the material on record, it can be said that the promise given by Jadhav to marry was a false promise. In our considered view, this is also not a case of breach of promise. At the most, it can be said that this is a case of cancellation of marriage," said the judges.
The court also ruled that no case of cheating was made out. "By no stretch of imagination, it can be said that the Jadhav's promise to marry Patil was fraudulent or dishonest and that, too, at the time of making the promise," the high court bench added.
Jadhav and Patil had met each other on a matrimonial site. According to Patil, she was introduced to his family and friends as his fiancée and had even made a visit to Dubai to meet Jadhav's
son. Patil claimed that despite agreeing to marry her, Jadhav delayed it. Finally in 2013, she lodged a complaint.
Jadhav, furnished emails written by Patil objecting to his first wife visiting his house and him maintaining contacts with her. Jadhav's lawyers pointed out that in his last letter to Patil he had sought to postpone the wedding and, in fact, it was her father who had responded by calling it off.
(Names changed to protect the couple's identity)

Kolkata: Contract killing to hide illicit affair

10-05-2015

KOLKATA: The gruesome murder that took life of education department employee Kartick Saha, was masterminded by his wife Sujata and her lover Kuntal. During interrogation, the duo have confessed engaging contract killers for the gruesome murder.
During interrogation Sujata broke down and confessed planning out Kartick's murder. Sujata, who came to know Kartick seven-eight month back, came very close to him. Since Kartick was resisting their extra-marital affair, Sujata and Kuntal decided to finish him off. The plan to kill Kartick was chalked out around 15 days back when Sujata secretly went to meet Kuntal at the Bidhannagar Station. They decided that the work had to be done in a way that they get scot free. The duo decided to engage two contract killers for that.

"We have also arrested Sujata following complaint against her. Duo have confessed that they masterminded the murder," said DC DD Kankar Prasad Barui. Kuntal, already in custody, had some connections in the underworld. He had already been following Kartick for long and knew his way back home. After the duo zeroed in on the date, they informed the killers the plan accordingly. Kuntal did not return home on Wednesday evening and accompanied the killers at a guest house in FD block of Salt Lake. Sujata's family members had already told police that she has been talking to Kuntal over phone till late in the night. In the morning Sujata informed Kuntal once Kartick was out for the morning walk.
Kuntal came out with the killers from the FD block guesthouse early in the morning. During interrogation Kuntal has told police that he hated Kartick and wanted to see him die. But Kuntal was aware that his mobile phone tower locations could trace him back to the spot once police starts investigation. In a bid to hoodwink police he changed the sim card of his mobile phone. The killers were carrying an axe to kill Kartick. While coming back from his walk Kartick had taken the route through CJ block. Finding the area deserted, killers decided to hit him there. They hit him with the axe from behind. To ensure that he dies they hit him twice again while Kuntal watched the entire episode.
Bidhannagar police had already arrested Kuntal following a complaint by Kartick's brother Narayan Saha. Later police arrested Sujata too. During face to face interrogation of Sujata and Kuntal, police found that they were talking about their affair over months. According to police sources, they were talking about different incidents of their love life.
A metropolitan magistrate court on Saturday had sent Sujata to five days' police custody. Police is now looking for the two killers.

Delhi man acquitted of rape charge

10-05-2015

NEW DELHI: A trial court has acquitted a man of the charges of raping his 12-year-old cousin, saying the girl had lodged a false complaint.

The court also noted that the minor's mother, a key witness, did not support the prosecution's case. It added that the medical report of the girl did not suggest she was raped or sexually assaulted. "The girl deposed that because the accused used to call her insane, she had lodged the present complaint," additional sessions judge Gautam Manan said.
The court absolved Samidul, a Jahangirpuri resident, of charges under sections 376(2)(f)(rape by a relative or person in authority towards woman) and 506 (criminal intimidation) of IPC, and Section 6 (sexual assault) of POCSO Act. Stating that the girl's mother also failed to support the prosecution case, the court said, "Mother of the girl has not supported the case of the prosecution and stated that on instigation of her neighbours, she got the complaint lodged against the accused through her daughter".
The court held that there was no evidence to prove that the minor was raped by the accused. "There is no conclusive medical evidence to establish that the girl was sexually assaulted by the accused. As per her (girl's) testimony, the investigating officer did not collect any forensic evidence to relate the accused with the allegations made in the complaint. Hence, there is no evidence on record to establish that the girl was raped by the accused".
According to the prosecution, in November 2014, when the girl was going to purchase oil from a shop, Samidul called her to his house and allegedly sexually assaulted her. It said that the girl told her aunt (accused'smother) about the incident but no action was taken and the next day her cousin again allegedly raped her. When she fell ill and her mother inquired, the girl narrated the incidents to her. Following this, a complaint was lodged and the accused was arrested. Later, the girl and her mother denied the allegations and said the accused was their relative and did not commit any wrong. The complaint was registered as he used to call her insane. During the trial, the accused had pleaded innocence and claimed he was falsely implicated.

Bride cancels wedding after groom's family sends 'sasta' lehenga

17 Nov 2022

Haldwani: In a bizarre incident reported from Uttarakhand's Haldwani, a bride cancelled her wedding after the groom's family sent her a 'cheap' wedding lehenga.

The girl from Rajpura neighbourhood was engaged in June. When she found out that the groom's family had bought her bridal lehenga that only cost Rs 10,000, she was not happy about it.

The couple's wedding was scheduled for November 5. On the day of the wedding, the furious bride refused to get married. The groom's father gave the bride his ATM card to buy a lehenga she liked but she could not be convinced.

The matter was reported to the Kotwali police after which the wedding was cancelled. In January, an Uttar Pradesh bride called off her wedding after the groom threw the varmala at her, instead of putting it around her neck as per the tradition. The incident was reported from Naveen Basti under the Bidhuna police circle.

After the bride refused to marry, both the families got into an argument. The groom denied having thrown the varmala. The families tried to persuade the bride to continue with the wedding rituals but she had made her decision. The police were called to sort out the matter. Both the families returned the exchanged gifts before parting ways.
